(Liber Extra) aus der Sicht der Text- und Handschriftenforschung, 2008. - Proveninenz: Nachlass eines Buchbinders. - Makulaturfragment aus einem Einband. - Seltener und früher Beleg zum Liber Extra. Es gilt neben dem Decretum Gratiani als wichtigste kirchliche Rechtssammlung des Mittelalters und der Frühen Neuzeit. Zur PALÄOGRAPHIE: Der Schreiber macht umfangreich Gebrauch von Abbreviaturen. Die weicheren Brechungen, iberische Ortsnamen im Text (Zamora, Ávila) und der rot-blaue Filigrandekor deuten auf ein südfranzösisches oder iberisches Skriptorium hin - möglicherweise im Umfeld einer kastilischen Kathedralschule oder Universität. Die Qualität der Initialen und die Regelmäßigkeit der Schrift deuten auf eine relativ frühe Abschrift hin, möglicherweise noch aus der ersten oder zweiten Generation der Überlieferung. Das Fehlen von umfangreichen Glossenapparaten (die Glossa ordinaria von Bernhard von Parma wurde ca. 1245 abgeschlossen) könnte auf eine frühe Kopie hindeuten, oder auf eine Gebrauchshandschrift ohne Standard-Kommentar. Zum INHALT: Die vorliegenden Seiten gehören zum Liber II (Zweites Buch) der Dekretalen, das sich mit dem Prozessrecht (iudicium) befasst. Insbesondere handelt es sich um Texte aus dem Titulus XXVIII: De appellationibus, recusationibus et relationibus (Über Appellationen, Ablehnungen und Berichte). Dies ist einer der umfangreichsten und juristisch bedeutsamsten Titel des gesamten Werks. Die Dekretalen behandeln Streitfälle über Appellationen an den Apostolischen Stuhl, missbräuchliche (frustratorische) Berufungen, sowie konkrete Konflikte zwischen Bischöfen und Klerikern in den spanischen Diözesen Ávila und Zamora. Erkennbar sind klassische päpstliche Formeln wie Pervenit ad nos und Ad aures. - Verso mit Leimresten von der Einbandverklebung. - Paläographisch und inhaltlich stellt der Codex ein wertvolles Zeugnis der Rezeption des kanonischen Rechts auf der Iberischen Halbinsel im 13. Jahrhundert dar.

Decretals of Gregory IX (also Liber Extra), Book II: De appellationibus. 49 lines. Two columns. Latin manuscript on parchment. Gothic textualis with rotunda tendencies. Text area 22.2 x 13.7 cm (overall 30.2 x 20.9 cm). Southern Europe, c. second half of the 13th century (c. 1240-1290). - Provenance: From the estate of a bookbinder. - Waste fragment from a binding. Rare and early evidence of the Liber Extra. Alongside the Decretum Gratiani, it is considered the most important collection of canon law from the Middle Ages and the early modern period. - On the PALAEOGRAPHY: The scribe makes extensive use of abbreviations. The softer angularity of the script, Iberian place-names in the text (Zamora, Ávila), and the red-blue filigree decoration point to a South-French or Iberian scriptorium, possibly in the milieu of a Castilian cathedral school or university. The quality of the initials and the regularity of the script suggest a relatively early copy, perhaps still from the first or second generation of transmission. The absence of extensive gloss apparatus (the Glossa ordinaria of Bernard of Parma was completed c. 1245) may indicate an early copy, or a practical manuscript without the standard commentary. On the CONTENT: The extant pages belong to Book II of the Decretals, which deals with procedural law (iudicium). More specifically, they contain texts from Title XXVIII: De appellationibus, recusationibus et relationibus (On appeals, recusals, and reports). This is one of the most extensive and legally significant titles of the entire work. The decretals treat disputes concerning appeals to the Apostolic See, abusive (frustratory) appeals, as well as concrete conflicts between bishops and clerics in the Spanish dioceses of Ávila and Zamora. Classical papal formulae such as Pervenit ad nos and Ad aures are recognisable. - Verso with glue residues from its use in a binding. - In palaeographical and textual terms, the codex constitutes a valuable witness to the reception of canon law on the Iberian Peninsula in the 13th century.
