Frankfurt a.O., Zeitler, 1678. - Bemerkenswerter Sammelband mit drei Texten des Hallenser Juristen, Philosophen und frühen Aufklärers Christian Thomasius (1655-1728), ergänzt um eine ältere wirtschafts- und eigentumsrechtliche Dissertation. Die enthaltenen Schriften behandeln zentrale Felder frühneuzeitlicher Rechts- und Sozialgeschichte: Folter und Strafverfahren, Konkubinat bzw. das Verhältnis von Ehe und außerehelicher Lebensgemeinschaft, den Magiebegriff und die rechtliche Verfolgung vermeintlicher Hexerei sowie Rechtsfragen zu Feldfrüchten und Getreide. Besonders hervorzuheben ist die 1705 erschienene Disputatio . de tortura ex foris Christianorum proscribenda, in der Thomasius die Folter aus christlichen Gerichtshöfen verbannt sehen wollte. Die Schrift zählt zu seinen wichtigsten Beiträgen zur Kritik des frühneuzeitlichen Strafverfahrens und zur Geschichte der Abschaffung der Folter. Thomasius begründete seine Ablehnung nicht nur praktisch, sondern auch rechtlich und religiös: Folter erschien ihm als ungerecht und mit christlicher Gerichtsbarkeit unvereinbar. Ebenso charakteristisch für Thomasius' aufklärerisches Rechtsdenken ist die Abhandlung De crimine magiae. Seine Auseinandersetzung mit der "Magie" richtete sich gegen die Voraussetzungen von Hexenprozessen, Thomasius bestritt letztlich die Möglichkeit eines Teufelspakts und wandte sich damit gegen die juristische Grundlage der Hexenverfolgung. Die Dissertation De concubinatu behandelt ein weiteres Kerngebiet seines moral-, familien- und naturrechtlich geprägten Denkens. Der Text erschien ursprünglich 1713 und liegt hier in einem Ulmer Nachdruck von 1732 vor. Die beigebundene Dissertation des Johann Friedrich Rhet über das Recht an Getreide und landwirtschaftlichen Erträgen erweitert den Band um eine wirtschaftsrechtliche Perspektive. Der Sammelband vereint damit Texte zu Strafrecht, Hexereirecht, Ehe- und Sexualrecht sowie Agrar- und Eigentumsrecht und dokumentiert in besonderer Dichte die Entwicklung des juristischen Denkens zwischen dem späten 17. und dem frühen 18. Jahrhundert. Insgesamt gut erhalten.

A remarkable composite volume containing three works by the Halle jurist, philosopher, and early Enlightenment thinker Christian Thomasius (1655-1728), supplemented by an earlier dissertation on commercial and property law. The included texts address central themes in the legal and social history of the early modern period: torture and criminal procedure, concubinage, or the relationship between marriage and non-marital cohabitation, the concept of magic and the legal prosecution of alleged witchcraft, as well as legal questions concerning crops and grain. Particularly noteworthy is the Disputatio . de tortura ex foris Christianorum proscribenda, published in 1705, in which Thomasius advocated the removal of torture from Christian courts. It ranks among his most important contributions to the critique of early modern criminal procedure and to the history of the abolition of torture. Thomasius grounded his opposition not only in practical considerations, but also in legal and religious ones: he regarded torture as unjust and incompatible with Christian jurisprudence. Equally characteristic of Thomasius's Enlightenment legal thought is the treatise De crimine magiae. His examination of "magic" challenged the premises underlying witch trials, ultimately, Thomasius denied the possibility of a pact with the Devil and thus opposed the legal foundations of witch persecution. The dissertation De concubinatu addresses another central field of his thought, shaped by moral philosophy, family law, and natural law. The text was first published in 1713 and is here present in a 1732 Ulm reprint. Johann Friedrich Rhet's bound-in dissertation on the law relating to grain and agricultural produce adds a perspective on commercial law to the volume.
