Geschichtswissenschaften – Erste Ausgabe des grundlegenden Kodex für das moderne österreichische Strafrecht. - ÖBL 2 (Lfg. 7, 1958), S. 116. - Nicht bei Durstmüller. - Im Handel von außerordentlicher Seltenheit, für uns historisch auf Auktionen kein einziges Exemplar nachweisbar. - Das »Strafgesetzbuch für Westgallizien« (1796) des Juristen und Präsidenten der Habsburgischen "Hofkommission in politischen und Justizgesetzsachen" Matthias Wilhelm von Haan (1737-1816) stellt die Grundlage für das österreichische Strafgesetz von 1803 dar. Das Gesetzeswerk wurde für das erst im Jahr zuvor im Rahmen der dritten Teilung Polens vom Habsburgerreich annektierte Westgalizien (weite Teile des heutigen Süden und Südwesten Polens mit den Städten Krakau und Lublin) verfasst, und sollte im Justizsystem der Habsburger als Testlauf für die Implementierung der im Zuge der von Kaiser Franz II. fortgeführten josephinischen Strafrechtsreformen dienen. - Schon in seiner Arbeit "Über die Tortur" hatte der junge von Haan u.a. neben Hormayr, Sonnenfels und Bannitza zu einer der wichtigsten Fragen der theresianischen Kriminaljustiz Stellung genommen, und war er dann unter Josef II. prominent mit den Reformen der Rechtsgesetzgebung und Verwaltung befaßt. Als gründlicher Kenner des römischen und deutschen Rechtes hatte er schließlich hervorragenden Anteil an der Vollendung des »Allgemeinen Bürgerlichen Gesetzbuches« (ABGB, 1811). Dem eigentlichen Gesetzbuch angehängt ist eine mehrfach gefaltete "Strafgerichtstabelle von Crakau für das Quartal vom 1. Januar bis letzten März 1797". - Provenienz: Vorderspiegel mit dem Besitzerstempel (aus der 1. Hälfte des 20. Jh.) "Piet Frühwald". - Am oberen Rand mitunter mit kaum merklichen kleinen Wasserflecken, hinterer Vorsatz minimal stockfleckig, sonst sehr sauberes Exemplar dieses rechtsgeschichtlichen Rarums.

History – First edition of the fundamental code for modern Austrian criminal law. - With title vignette in wood-cut (Habsburg double eagle emblem of Emperor Franz II) and folding table. - The 'Penal Code for Western Galicia' (1796) by the lawyer and president of the Habsburg 'Court Commission for Political and Judicial Matters' Matthias Wilhelm von Haan (1737-1816) forms the basis for the Austrian Penal Code of 1803. The law was written for Western Galicia (large parts of what is now southern and southwestern Poland, including the cities of Krakow and Lublin), which had been annexed by the Habsburg Empire only the year before as part of the third partition of Poland, and was intended to serve as a test run for the implementation of the Josephine criminal law reforms continued by Emperor Franz II. In his work 'Über die Tortur' (On Torture), the young von Haan, alongside Hormayr, Sonnenfels and Bannitza, among others, had already commented on one of the most important issues of Theresian criminal justice, and under Joseph II he was prominently involved in the reforms of legislation and administration. As a thorough expert in Roman and German law, he ultimately played an outstanding role in the completion of the 'General Civil Code' (Allgemeines Bürgerliches Gesetzbuch (ABGB), 1811). Attached is a folded 'Cracow Criminal Court Table for the quarter from 1 January to the end of March 1797'. - Provenance: Front cover with owner's stamp (from the first half of the 20th century) 'Piet Frühwald'. - Occasionally small water stains on the upper edge, minimal foxing on the rear fly-leaf, otherwise a very clean copy of this juridicum, extremely rare in trade, no copy traceable for us at auction whatsoever.
